Tenant re-rents at a profit

This morning I was reading the  Small Property Owners Association Newsletter and I came across this story.

An East Cambridge owner of a two-family property reports that she rented out her three- bedroom unit upstairs to a single man who truned around and re-rented the unit to four students, charging them in total more than the rent he paid the owner downstairs.

The initial tenant agreed to pay a rent of $1650, which included parking and all utilities. He turned the dining room into another bedroom, charging each student $450.00 a month for a private bedroom as advertised on craigslist.org. He also charged $125 per month for the parking space. The initial tenant is receiving  a total of $1925.00 per month in rent.

Perhaps worst of all, the landlord wanted a single or couple living in her unit upstairs and now she has “I have drinkers, smokers and partyers who dance until two o’clock in the morning, keeping me up at night.”

The initial tenant told the students that he was doing this same arrangement in many other places in Cambridge and Boston and is “teaching” them how to do it, too via Craigslist.org.

The eviction process has begun…..

    Oh, so the landlord wanted to discriminate based on marital status, profession, age, and number of children, and instead got a subletter. Boo hoo.

    Now, I agree it’s a crappy thing to do, and if the original lease requires sublease approval from the landlord, it’s definitely a breach of contract. But otherwise it’s just arbitrage, as far as I can tell.

    Actually, if it is an owner occupied two-family, the landlord has the right to refuse to rent to anyone for any reason they like. They are legally entitled to discriminate based on marital status, profession, zodiac sign, or hair color if they want to.

    Raphael Holoman Franklin huh? This guy scams many students, old persons, vets, foreigners and I BET he is affiliated with a religious organization

    Hi. I see the name “Raphael Holoman-Franklin” mentioned in one of the reader comments here. Is your article about him? I was his housemate in 2008, when he rent scammed several Cambridge residents out of thousands of dollars. I set up a blog about this at:

    This jerk is actually BACK in Cambridge, and future victims are out there. We learned that he was staying with an unsuspecting family 5 or 6 doors down from us. The father became suspicious of him when he boasted of having attended a (non-existent) college at Yale. The father did go to Yale. Holoman-Franklin ingratiates himself to people, impresses them with religious/charitable activities, and then scams them. Police can or will do nothing.

    I wish that real estate people could help get the word out about him. He’s brazen, lies through his teeth, and people feel sorry for him and get taken every time.
