Banks, collection firms pursue claims after homes foreclosed

Massachusetts homeowners who’ve lost properties to the state’s foreclosure crisis are finding that their troubles don’t necessarily end when the auctioneer’s gavel falls.

That’s because foreclosure auctions in today’s weak housing market rarely net enough to pay off properties’ first mortgages, let alone any second liens.

Bay State consumers are often technically on the hook for any remaining balances under laws lenders haven’t traditionally enforced, but are beginning to employ more and more.

What are you thoughts? Should homeowners be responsible for mortgage debt after the foreclosure?

    Heck, yeah! The bank upheld their part of the contract, it’s only right that the borrower do the same.

    Hello Anon2,

    I think it all comes down to how the note/mortgage was wriiten if it’s only secured by the property than shame on the bank if the value of the property goes down.

    anon2, Question. Should the banks take any reponsibility of risk? No income verification no problem, if the homeowner lost his job…… the govt will bail out the bank.

    I agree with JF.

    While home owners shouldn’t get off the hook so easily, lending institutions and their employees have a responsibility to the shareholders to increase profits, while also protecting the company’s balance sheet.

    This is like Enron IMO. Lies and lack of oversight were ok’ed by the silence from above as long as the profits were rising.

    Unfortunately, too big to fail meant they had an ace in the hole.
