Tenant rejected because of Facebook

This is a first for me – I presented a tenant application to a Boston landlord and after reviewing the paper work the landlord requested that I do a search of the applicant on Facebook. The result: It revealed a Facebook page of the potential occupant which included pictures that raised an eyebrow with my landlord. While I’m not privy to write exactly what the problem was, just let’s say the owner became worried about loud parties and promiscuous non-mother approved activities. In other words, to say that the Facebook page projected a questionable image would be an understatement.

Fair? It’s hard to say. Sometimes a picture is worth a thousand words. Sometimes pictures lie. In today’s wired world of social networks, potential landlords and employers are finding out more than you might think.

    It’s still a shock to me how people just don’t realize that social media, when uncensored, can really throw a wrench into their lives.

    Just goes to show that for all the good that can come with social media, there’s a lot to be lost too. Must be some facebook page though.

    Dumb kid is dumb.

    There’s no reason to keep a wide open profile tied to your name on the internet, unless you want that to be your public persona.

    Even with facebooks’ lax privacy options you can ban outsiders from access, and even friends of friends.

    Still, I do wonder what the legality of such a move is by the landlord. John, could you comment more on that?

    never post anything on Facebook, or anywhere else on the internet that you wouldn’t want people to know about…common sense people!

    Big brother?

    I don’t think this is a big brother sort of thing at all. Facebook is public – they aren’t being spied on, they are putting the info out in public themselves.

    Now if employers viewed video from surveillance cameras that took video outside the local bars…

    I think that’s fair. A propensity for loud parties is a valid reason to reject someone as a tenant, not a form of legal discrimination. The landlord has other tenants to think about.

    Funny, I know of no law that states you can’t turn down a potential tenant because they admit on Facebook they’re reckless individuals that participate in loud parties that could infringe the right of “quite enjoyment” of other tenants in the bldg. My guess, at somepoint someone will file a lawsuit claiming they’ve been descriminated.

    Other people can post pictures of you, and tag them. So you have to be diligent about un-tagging.

    Maybe you could use the privacy settings to prevent other people from tagging photos to your account, but they could always do a tag just to your mname anyway.

    I think John is right. “Party Animal” is not class of person legally protected against discrimination.
