Key Details of the 2025 Law

Landlord-Hired Brokers: If a landlord hires a broker to list, market, or show their apartment, the landlord is responsible for paying that broker’s fee. Landlords can no longer require tenants to pay a broker fee as a condition of signing a lease.
Tenant-Hired Brokers: A tenant is only responsible for paying a broker fee if they independently hire a broker to act exclusively on their behalf to find an apartment.
No Dual Fees: A broker cannot collect a fee from both a landlord and a tenant for the same transaction, and they cannot represent both parties if they are collecting fees from both.
Advertising Restrictions: Real estate agents are prohibited from advertising rental listings that state “tenant to pay broker fee” if they were hired by the landlord.

What Tenants Should Know
