- Landlord-Hired Brokers: If a landlord hires a broker to list, market, or show their apartment, the landlord is responsible for paying that broker’s fee. Landlords can no longer require tenants to pay a broker fee as a condition of signing a lease.
- Tenant-Hired Brokers: A tenant is only responsible for paying a broker fee if they independently hire a broker to act exclusively on their behalf to find an apartment.
- No Dual Fees: A broker cannot collect a fee from both a landlord and a tenant for the same transaction, and they cannot represent both parties if they are collecting fees from both.
- Advertising Restrictions: Real estate agents are prohibited from advertising rental listings that state “tenant to pay broker fee” if they were hired by the landlord.
- Leases Signed Before August 1, 2025: The law is not retroactive. If you signed a lease before this date that included a broker fee, you may still be legally required to pay it.
- Indirect Costs: While landlords cannot charge an upfront broker fee, they are permitted to increase the monthly rent to recoup the cost of paying the broker.
- Reporting Violations: If a landlord or broker attempts to force you to pay a fee for a broker you did not hire, you can file a complaint with the Massachusetts Attorney General’s Office or the Division of Occupational Licensure.
